Probate Process

We assist the executor of a will or administrator of an estate with the initial proceedings to petition to probate an estate. We ensure that the executor or personal representative of the will or estate is effectively appointed through the court and complies with any notification requirements. If the administrator or executor is the sole heir to the estate, the petition may be heard by the Probate Master and the process may be completed more quickly. We also have experience as a Guardian ad litem, Conservator, Trustee, Attorney for Executor or Personal Representative or heir representing all interests involved in the probate process. Our attorney has extensive experience in negotiating the settlement of the Decedent's debts and estate.

Will Disputes

If there is a will contest or dispute, our firm represents the estate through negotiation and litigation to resolve the dispute. Often times, a will can be self-proving and found a valid will, if it is signed by a notary and the required witnesses at the time it is signed by the testator. The court may hear attesting witnesses and other testimony to verify the signature and the state of mind of the decedent at the time of signing to ensure the will conforms with all laws and was not a result of persuasion or undue influence.

Complex Probate Law

Our firm has handled many unusual probate matters involving blended families, special needs trusts, lengthy trust administrations, will construction suits, contested wills, contested conservatorships, cash poor estates, or other complex probate situations and matters. We are also experienced handling probate matters involving the following:
